Tucson wins first round of vaccine mandate battle

TUCSON, Arizona (KOLD News 13) – Tucson has won the first round to keep its vaccine mandate intact.

Katherine Cooper, a Maricopa County Supreme Court judge, ruled the state violated its own laws when it passed a series of anti-mask and vaccine laws at the end of the previous legislature.

The legislature appended the COVID laws to household bills and thus violated the state law against several subjects in a single law.

Arizona Attorney General Mark Brnovich filed the lawsuit against Tucson’s vaccine mandate on Sept. 7, calling it illegal and giving the city 30 days to overturn it or risking a loss of $ 130 million in state shared revenue .

This is controversial for the time being.

“We will appeal this judgment. It is unfortunate that left groups want to undermine the legislative process and indoctrinate our children with critical racial theory and want to impose vaccines they do not want. I will continue to stand up for the rule of law and the people of Arizona, ”Brnovich said in a statement.

On August 13, the mayor and council passed a vaccination mandate that required a vaccine as a condition of employment. That was changed to a five-day ban with no pay.

“My expectation is that we will continue to pause the discipline and apply the job restriction until this is fully resolved in court,” said Steve Kozachik, Councilor of Ward 6. “We will likely put our discipline on hold until the litigation is resolved. “

The city council will meet behind closed doors at its regular session on Tuesday, September 28th to determine next steps.

“Mark Brnovich is not going to fold his tent, and neither are we,” said Kozachik. “As the litigation spreads, we will keep our options open.”
