Hearings on a federal labor complaint against Tucson-based copper miner Asarco LLC have been postponed amid new indictments by the company’s unions after a nearly nine-month strike that ended last summer.

The National Labor Relations Board has temporarily postponed hearings on its complaint of unfair labor practices against Asarco, which was due to begin October 19.

The case is based on charges brought by United Steelworkers and six other unions, representing approximately 1,800 members, who went on strike at Asarco sites in Arizona and Texas in 2019 after accusing the company of malicious negotiations and several allegedly unfair labor practices.

The postponement resulted from new guidance from the NLRB’s General Counsel, forcing regional NLRB directors to bring certain matters to the agency’s advisory department, the union said.

The director of Phoenix-based NLRB Region 28 filed his case against Asarco with the Advisory Department to investigate an issue regarding the company’s alleged unlawful refusal to negotiate and execute its “last, best, and last” deal, the company said Labor union .

In April, the NLRB Regional Director filed a fourth consolidated complaint against Asarco, based on unions’ complaints about several alleged illegal practices, including malicious negotiations, unilateral changes in working conditions and the failure to contact workers who returned from the strike last summer were to be hired again.
