TUCSON (KVOA) – Back in April, Governor Ducey signed a law known as the Second Amendment Firearm Freedom Act.
On Tuesday, the Tucson Mayor and Council moved forward to break the law.
The Council discussed HB 2111, the 2nd amending law on the freedom of firearms. Councilor Kozachik asked the council to direct staff to work on a resolution to make #Tucson federal gun laws apply in the city, regardless of what the state says. “They have a history of wanting to forestall any local decision-making regarding gun legislation. This is one where they have crossed the line,” said Steve Kozachik, Tucson city councilor.
Councilor Steve Kozachik asked the Mayor and Council of Tucson to pass a resolution separating them from House Bill 2111.
“So I hope it happens the moment we adopt this resolution and announce to the governor’s legislature that we will recognize the federal gun laws,” Kozachik said. “That forces them to sue us. We meet them on the courthouse steps and say your annulment is unconstitutional, it is void and just goes away.”
House Bill 2111 went into effect in April and states that any law in violation of the second amendment will be null and void in the state of Arizona.
“This legislation is irresponsible. It is unconstitutional and unnecessary and especially in June, the month of gun violence awareness, “said Tucson Mayor Regina Romero.
During the meeting, the mayor and the council voted for the city attorney to make the decision to vote.
“Really put lemon on the gun violence wounds in our country and in the state,” said Romero. “I am honestly disgusted with the lack of movement in Congress to pass decent gun laws.”
We asked Governor Ducey’s office for comment and they sent us the following statement:
“Governor Ducey is proud of his record on the second amendment and believes that the rights of the second amendment should be protected as we protect public safety.”
The Tucson City Attorney is expected to hear from him on Jan.
